LaSemo asbl is concerned about privacy, in accordance with the provisions of the General Data Protection Regulation (GDPR) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

Although most of the content on this site is available without the need for personal data from visitors, visitors may be asked to provide personal data. LaSemo ASBL uses its data exclusively to respond to requests for information and/or to keep visitors informed of the latest news about the LaSemo festival. This data will not be resold, transferred or rented to a third party.

You have the right to access, modify, rectify or delete your personal data. If you wish to exercise this right, you can do so by sending us an email at [email protected]. The change will be made within a maximum of 50 days of receipt of your request.

Applicable law and competent courts

This site is governed by Belgian law. Only the courts of the district of Brussels are competent in case of dispute.

GENERAL CONDITIONS OF SALE LASEMO:

Preamble

These General Terms and Conditions of Sale govern the sale of tickets, the formation of the contract
and the mutual rights and obligations of the Customer/Festival-goer, the Ticket Vendor and
the Festival Organizer.

The present General Conditions are an integral part of the contract resulting from the order
one or more tickets for the Festival.

Article 1: Scope of application

By booking a ticket and/or entering the Festival grounds, the Client/Festivalgoer explicitly acknowledges that he/she has read and accepts all of these Terms and Conditions.

Article 2 : Reservation terms and conditions

The reservation of a ticket is only effective after the payment of the amount due has been received by the Ticket Seller.

Tickets are sold via the Ticket Seller’s online platform and, in some cases, via physical points of sale. Only the physical outlets listed on the official Ticket Seller website are valid. No purchase at any other point of sale guarantees the validity of the ticket and therefore access to the Festival.

When purchasing a ticket(s) via the Ticket Seller’s online platform, the booking offer will only be effective if the mentioned payment deadlines have been met. This time limit will be applied even more strictly when the number of tickets available for an event or for a price category within that event is nearly exhausted.

Tickets purchased via the Ticket Seller’s online platform can be downloaded and/or sent by email. The tickets must be printed by the Customer on white paper and in such a way that all the information contained therein is perfectly legible. The printing costs are at the expense of the Customer.

In all cases, the service and administration fees are definitively acquired by the Ticket Vendor upon receipt of the payment of the amount due by the Festival Holder.

VAT and other taxes are at the expense of the Client/Festival holder.

The individual or company making the reservation is responsible for the payment of the reservation, even when acting on behalf of third parties.

The right of withdrawal does not apply, as the service (ticket reservation) is performed immediately.

After payment, the ticket is neither refundable nor exchangeable.

Where the Organizer provides for a pre-sale of tickets at a price lower than the price of tickets purchased at the Festival site, such pre-sale shall end no later than the opening of the site or campsites by the Organizer to Festival-goers. From that moment on at the latest, the tickets are at the price displayed on site, higher than the presale price.

Article 3 : Ownership and prohibition of resale

Counterfeiting, in any form or by means of any process whatsoever, is strictly prohibited and will be prosecuted.

Tickets cannot be resold. Resold tickets do not entitle the holder to admission to the Festival. If the Organizer finds that tickets are offered for sale, it reserves the right to cancel these tickets and to refuse the bearer access to the Festival, without the right to a refund of the purchase price of the tickets.

All persons entering the Festival grounds must be in possession of a ticket and proof of identity. Proof of identity” means a valid identity card, passport or driver’s license. Copies of identification documents will not be accepted. In the event that a Customer/Festivalgoer is not in possession of a valid ID, access to the Festival grounds may be denied, without the right to a refund of the purchase price.

Each ticket has a unique identifier and will only give access to the first person presenting it at the Festival entrance.

Tickets may not be used or provided to third parties for commercial or business purposes without the express permission of the Organizer.

Article 4: Security

Entry to the Festival site implies acceptance of all preventive and control measures taken by the Organizer or the security team, including body and bag searches. Failure to comply with these measures may result in the refusal or withdrawal of the right to enter the Festival, without the right to a refund of the purchase price of the ticket.

The Organizer reserves the right to refuse or withdraw access to the Festival site from any Festival participant whose behavior could be detrimental to the safety of the Organizer or third parties or, in general, to the smooth and peaceful running of the Festival.

In addition, for a compelling and demonstrable safety reason or upon the advice of the authorities, the Organizer reserves the right to:
– suspend or terminate the Festival;
– to maintain temporarily and until further notice the festival-goers on the grounds of the Festival;
– ask festival goers to leave the festival grounds.

In this case, tickets are not refunded or exchanged.

A refund of the Festival ticket is not possible in any case if a Customer/Festival-goer wishes to cancel his or her ticket due to a concern about, for example, a terrorist threat and/or attacks, …

Article 4: Security

In addition, for a compelling and demonstrable safety reason or upon the advice of the authorities, the Organizer reserves the right to:
– suspend or terminate the Festival;
– to maintain temporarily and until further notice the festival-goers on the grounds of the Festival;
– ask festival goers to leave the festival grounds.

In this case, tickets are not refunded or exchanged.

A refund of the Festival ticket is not possible in any case if a Customer/Festival-goer wishes to cancel his or her ticket due to a concern about, for example, a terrorist threat and/or attacks, …

Article 5: Prohibitions

The Client/Festivalgoer is not allowed to bring onto the Festival site any professional cameras or recording equipment, any weapon or sharp object, any glass object, any object considered dangerous by the Organizer, any animal (except dogs accompanying visually impaired persons), electrical appliances, sound or music amplification, gas burners, stoves or other explosives, aerosol deodorants, illegal/prohibited substances, large gas cylinders over 450g, beverages (except baby bottles and baby food), and picnics wrapped in foil or other future waste.

Failure to comply with these prohibitions may result in the refusal or withdrawal of the right to enter the Festival, without the right to a refund of the purchase price of the ticket.

Only empty water bottles, snacks (fruit, cookies, chocolates) and lunch boxes are allowed.

The following actions are expressly forbidden on the Festival site and may result in the refusal or withdrawal of the right to enter the Festival, without the right to a refund of the purchase price of the ticket:

– display or advertise any product, event, brand or other concept without the express prior written consent of the Organizer;
– use or sell drugs;
– engage in conduct intended to disturb the peace or incite violence;
– enter areas where the ticket does not give access;
– damage in any way the infrastructures, the material, the decoration and any other element on the site; any damage or consequence of the degradations produced by a Festival member will be charged to him;
– block accesses, exits and emergency exits;
– sell food, drink or any other product without the express permission of the Organizer;
– throwing (or shooting) objects in solid, liquid or gaseous form;
– smoking or vaping in areas where it is prohibited;
– urinating in public;
– park a vehicle without the express permission of the Organizer; the vehicle may be removed at the owner’s expense;
– steal decorations or any other material from the Festival;
– making fire ;
– displaying texts, symbols, objects, clothing and/or other (visible) expressions explicitly representing a political or social movement or grouping; any element constituting a form of discrimination, exclusion or racism is strictly prohibited;
– put other festival-goers at risk.

The Organizer reserves the right to permanently exclude anyone who does not respect the present General Conditions or the spirit of the Festival. No compensation can be claimed by the excluded person.

Article 6: Liability

The organization of the Festival (including, but not limited to, the schedule, times and locations of the various events, ticket prices and the number of tickets offered for sale) is the responsibility of the Organizer. The Ticket Seller is solely responsible for the sale of tickets and the shipping of tickets.

The Ticket Seller shall not be liable for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, disruption of service, or other unintended problems.

The Organizer is only liable for direct damages that a Festival participant may suffer as a direct and exclusive consequence of a breach attributable to the Organizer. Only damage for which the Organizer is insured and for which the insurer pays compensation will be taken into account for any compensation.

The Organizer’s liability is in any event limited to the amount actually paid by the insurer. Not considered for compensation are: (i) consequential damages, (ii) immaterial damages and (iii) damage resulting from the willfulness or recklessness of the Festival member.

Entry to the festival site is at the risk of the customer/festival-goer. The Organizer is not liable for any damages resulting from entering the venue and/or attending the performances, such as hearing, sight and other physical problems.

Program changes do not result in a refund, either partial or total, of the ticket. The Organizer can in no way be held responsible for the absence or delay of any of the artists announced on the Festival’s promotional materials.

The Organizer has the right to cancel or postpone the Festival in case of force majeure or if it has any other compelling and demonstrable reason to do so. Force majeure includes, but is not limited to: terrorist threats, terrorist attacks, unfavorable weather conditions, strikes, fire, war, acts of God, epidemics, illness of the artists, failure and/or delay in technical infrastructures, failure and/or delay in means of transportation, etc. In this case, the responsibility of the Organizer is excluded. Tickets are neither refunded nor exchanged.

Lost or stolen tickets are the responsibility of the customer/festival-goer and will not be replaced or refunded.

Article 7: Personal data

In the course of booking tickets, the Ticket Seller and the Organizer receive personal data from the Customer, such as name, surname and contact details. The Customer agrees to provide correct and complete information.

In order to execute the purchase, the Organizer must share the Customer’s/Festivalgoer’s data with third parties.

By agreeing to the Terms and Conditions, the Customer/Festivalgoer gives their explicit consent to share their data with the following parties and for the following purposes:
– process tickets and payments,
– send the tickets,
– to inform the Customer who wishes it of the innovations by email,
– to manage access to the Festival as best as possible,
– to manage the possible contestations of the Customer,
– inform the Customer of practical information related to the Festival,
– manage cashless payments at the Festival and cashless refunds,
– take measures for safety, protection and health.

If permitted or required by law, the Ticket Seller and the Organizer may share such personal data with public authorities and institutions to protect and enforce its rights or the rights of third parties or to investigate and prevent fraud or other crimes or attempted crimes.

The Organizer may receive negative advice from public authorities or institutions regarding the ticket holder’s entry to the Festival. In this case, the Organizer has the right to refuse or withdraw access to the ticket holder, which does not give any right to financial compensation.

Ticket Seller and Organizer may share data with the following partners:
– processing and shipping companies
– public authorities and institutions
– direct mail companies
– operational staff at the Festival
– payment processing companies
– printing companies
– security and health companies and their staff
– transport companies

In order to promote the Festival, the Customer’s/Festivalgoer’s data will be kept for an indefinite period of time, unless the right to be forgotten is exercised.

In accordance with the law of July 30, 2018 on the protection of individuals with regard to the processing of personal data, the Customer/Festival-goer may have access to the personal data concerning him/her, make changes to it or object to its processing.

By entering the Festival site or by participating in it, the Festival participant expressly gives his or her consent in two ways:
– on the one hand, to be photographed and / or filmed, on the site of the Festival by any person or entity authorized by the Organizer;
– on the other hand, the publication, distribution and use of any image, photo, video or other reproduction via physical or digital media and for any purpose.

The digital images in question may be used by the Organizer for promotional and/or commercial purposes for the Festival. In addition, business partners and/or media may use these images.

The recording and storage of the images in question by the police and/or the Organizer may take place in the context of maintaining order and security on the festival site, as well as for the purpose of preventing, detecting and convicting offences and breaches of the General Terms and Conditions through identification by means of the digital images.

Any Client/Festival holder has the right to object to the processing of data for promotional and commercial purposes at no cost by means of a written notification sent to the email address [email protected], or by mail to the Organizer’s headquarters. Any Customer/Festival participant may also request the Organizer in writing and free of charge to remove, modify or improve their data. The change will be made within a maximum of 50 days of receipt of the request.

If a Client/Festivalgoer wishes to make use of his right to oblivion (deletion of his data), the Organizer is obliged to remove all such data and consequently can no longer offer his services, nor give him access to the Festival. The order will be cancelled without entitlement to a refund.

In the absence of the Organizer’s prior written authorization, the photos or films taken by the Clients/Festival-goers on the Festival site cannot be used for commercial or public purposes.

Article 8 : Sale of Festival items

The official sale of the Festival items is done only on the Festival website.

In accordance with the European Directive 1999/44/EC, which has been transposed into Belgian law in articles 1649bis-1649octies of the Civil Code, the Customer has a legal guarantee of two years for physical purchases.

Article 9: Cashless payment system

On the festival site, a cashless payment system can be used to buy drinks and meals in the different bars and foodtrucks of the festival. At the entrance of the Festival, each Client/Festival-goer receives a bracelet with a chip that can be recharged at the points of sale installed on the Festival site, either by credit card or with cash.

Any problems with the cashless payment system must be reported to the Organizer immediately at the time of the Festival, under penalty of forfeiture. The Organizer reserves the right to refuse a claim if no proof is presented.

The Organizer cannot be held responsible for the theft or loss of the bracelet. In case of loss or theft, the Customer/Festivalgoer can deactivate the chip by going to the festival HQ.

Article 10: Applicable law, competent jurisdiction and general provision

The present General Conditions are governed by Belgian law.

When, by virtue of the application of a law, a regulation or following a final decision of a competent court, one or more stipulations of the present General Conditions are held to be invalid or declared as such, this does not affect the other stipulations of the present General Conditions which remain in force.

The parties agree to replace the provision(s) with the valid or binding alternative provision(s) that most closely approximates the intent of the provision(s) that has been declared illegal, void or unenforceable.

In case of dispute, only the courts of the district of Brussels are competent.

These terms and conditions are qualified in their entirety and without prejudice to any recognition on the part of the Organizer and the Ticket Vendor.
